Filing Under the Federal Tort Claims Act
Military Medical Malpractice and the Federal Tort Claims Act
If you are injured at a VA hospital, Army base hospital or by a government doctor, you may be entitled to make a claim against the U.S. government. Usually this means filing a claim under the Federal Tort Claims Act.
An attorney experienced with the Federal Tort Claims Act and licensed in federal court can help file your administrative claim. You have two years after your injury to file a claim with the appropriate administrative agency. If you filed a claim yourself and have not received an answer within 6 months, you can consider your claim denied, and then file suit. There are special rules that apply, such as no right to a jury trial (bench trial only), and attorney fees are limited to 25% of the recovery. Contact a lawyer experienced in Federal Tort Claims Act cases.
